Equipment Condition:

NWS specializes in the buying and selling of surplus medical & scientific equipment. Unless otherwise specified on this invoice, all items sold are pre-owned and "as is", not refurbished.

Availability:

Availability is subject to stock on hand and/or prior sale. The availability, delivery and timing of some products may be contingent on providers outside of the direct control of NWS.

Terms:

All sales are final. Past due accounts will be assessed 1.5% per month and may be submitted for collections. Related collections fees will be assessed over and above any balance due.

Warranty:

Items are sold as-is without warranty expressed or implied unless otherwise stated. Any stated warranties are in effect from the date of shipping. NWS reserves the right to repair, replace or refund (less cost of shipping) any item requiring warranty service.

Shipping:

You, the buyer, are responsible for all shipping fees unless otherwise specified. You are responsible to inspect all goods immediately upon delivery to check for shipping damage. Suspected damage should be noted with the shipping agent at delivery. You must document and report to shipping company within 5 days as well as preserve packing materials and evidence of damage. Failure to do so will result in the loss of your rights to file a claim.

Order Fulfillment:

NWS will make every reasonable effort to insure that you receive all products as ordered. However, if for any reason we are unable to fulfill any part of an order, you will be entitled to a full refund for that item. NWS will not be liable for any losses other than the actual cost of equipment.

Disputes:

Any disputes arising from this transaction shall be governed by the laws of State of Washington in the venue and jurisdiction of Clallam County.

Signature:

By signing this document, you acknowledge that you are an authorized purchaser for Company named and that you have read, understood and agreed with all terms and descriptions outlined on this document. The receipt of payment, Purchase Order or acceptance of goods shall also indicate your acceptance of these terms.
